Terms of Service, Kisii Pest Control

These Terms of Service ("Terms") govern your use of Kisii Pest Control’s services, website, training programs, product sales, supplier interactions, and any related activities we provide in Kisii County and surrounding areas. By requesting or accepting any service, product, training, or supplier arrangement from Kisii Pest Control, you agree to be bound by these Terms. Please read them carefully. If you do not agree, do not use our services.

1. Who we are and contact information

Kisii Pest Control provides pest management, mosquito net supply and installation, sanitary bin supply and servicing, cleaning and hygiene services, training programs, and supplier procurement services.

2. Scope of services

  • We provide inspections, quotations, one-off treatments, recurring maintenance plans, product sales and installations, training and certification, and supplier coordination.
  • Specific terms for a job (scope, price, schedule, guarantees) will be set out in written quotations, service agreements, or invoices. Those documents, once accepted by the customer, form part of the contract between you and Kisii Pest Control and take precedence where they conflict with general Terms.

3. Bookings, quotes and acceptance

  • Quotes: We provide written quotations following an inspection or on request. Quotes are valid for the period specified on the document.
  • Acceptance: A booking is confirmed when you accept a written quote and any required deposit is paid, or by mutual written agreement (email counts).
  • Changes: Any changes to scope, timing, or pricing after acceptance must be confirmed in writing and may incur additional charges.

4. Prices, deposits and payments

  • Prices: Fees are as quoted and may vary by service type, property size, infestation severity, or product specifications. Prices exclude any applicable taxes unless stated.
  • Deposits: For some services, installations, training courses, or special orders, a non-refundable deposit may be required to secure the booking or cover supplier costs. The deposit amount will be stated in the quote or agreement.
  • Payment terms: Payment terms will be shown on the invoice or agreement. Unless otherwise agreed, full payment is due on completion of service or as per invoicing terms. Late payments may attract interest or collection charges.
  • Methods: We accept payments by bank transfer, mobile money where available, or other methods agreed in writing. If you dispute a charge, contact us promptly at service@rafikipestcontrol.com

5. Cancellations and rescheduling

  • Customer cancellations: Cancellation policies and any applicable fees will be stated in your quote or agreement. In general, cancellations made more than 24 - 72 hours before a scheduled appointment may be refunded minus any administration fees; late cancellations may incur a cancellation fee.
  • Rescheduling: We allow reasonable rescheduling but repeated rescheduling or last-minute changes may be subject to fees.
  • Company cancellations: If we must cancel due to our circumstances (staffing, supply issues, safety), we will offer an alternative date or refund any prepayment for the cancelled appointment.

6. Preparation and customer responsibilities

  • Access and safety: You must provide safe access, accurate information about the property, and disclose relevant health or safety information (for example, allergies, presence of vulnerable individuals, pets, or special equipment).
  • Preparation: Certain treatments require preparation (removing food, covering utensils, vacating premises for a specified time). Failure to follow preparation instructions may reduce treatment effectiveness and could void guarantees.
  • Liability for non-compliance: Kisii Pest Control is not liable for treatment failure resulting from customer non-compliance or actions that reintroduce pests after treatment.

7. Product sales and installations

  • Product specifications: We will supply products that match the agreed specifications. Custom or special-order items may require lead times and are often non-refundable unless defective.
  • Installation workmanship: We warrant that installations will be performed with reasonable care and skill. If installation defects arise from our workmanship, we will rework or repair as appropriate.
  • Ownership: Title to physical goods passes to you on full payment unless otherwise stated in writing.

8. Guarantees, re-treatments and limitations

  • Guarantees: Some services include a guarantee period during which re-treatments for the same infestation may be provided free of charge, subject to the terms in your quote or agreement. Guarantees exclude infestations caused by customer behavior, new introductions, or external factors outside our control.
  • Reasonable attempts: Where treatment does not succeed after reasonable re-treatment attempts and the failure is due to our processes, we will discuss further remediation, pro-rata adjustments or refunds as appropriate.
  • Exceptions: Guarantees do not cover damages caused by pest activity prior to service, costs associated with removal/replacement of damaged items, or third-party causes.

9. Health, safety and use of chemicals

  • Lawful and safe products: We use industry-approved products and follow safety guidelines. You must disclose health conditions, pregnancies, allergic reactions, or presence of sensitive animals to enable us to choose safe treatment options.
  • Post-treatment instructions: Follow any post-treatment instructions provided. We are not liable for harm arising from failure to follow safety advice.
  • Emergency incidents: Report suspected adverse incidents immediately. We will investigate, and where an incident is due to our service or product, we will cooperate on corrective action.

10. Liability and indemnity

  • Limitation of liability: To the maximum extent permitted by applicable law, Kisii Pest Control’s liability for direct loss arising from our services or products is limited to the amount paid by you for the specific service or product that gave rise to the claim. We are not liable for indirect, consequential, special, punitive or incidental damages (including loss of profits or business interruption).
  • Indemnity: You agree to indemnify Kisii Pest Control against third-party claims resulting from your negligence, failure to follow instructions, or misrepresentation of facts.
  • Force majeure: We are not liable for delay or failure to perform caused by events beyond our reasonable control, including natural disasters, strikes, supply shortages, or government actions.

11. Intellectual property

  • Materials provided by us: All materials, manuals, training curriculum, website content, images and documents created by Kisii Pest Control remain our intellectual property unless otherwise agreed. You may not reproduce, publish or distribute these materials without our written permission.
  • Customer-provided content: You retain ownership of content you provide (photos, logos, documentation), but grant us a license to use such materials for the purpose of delivering services, marketing (with consent), or record-keeping.

12. Privacy and data protection

  • Personal data: We collect and use personal information to provide services, process payments, manage training and supplier relationships, and communicate with you.   • Communications: By providing contact details you consent to receive communications related to service delivery, safety notices, invoices and, where consented, marketing messages. You may opt out of marketing at any time.

13. Training programs

  • Enrollment: Training enrollments are confirmed upon payment and any required documentation. Course materials, exams and certificates are provided as described in the training offer.
  • Cancellation and refunds: Training cancellations and refund terms are set out in the course information. Cancellations outside the specified periods may be non-refundable. No-shows are generally non-refundable.
  • Conduct: Trainees must follow safety and conduct rules. Kisii Pest Control may remove participants for unsafe, illegal or disruptive behavior without refund.

14. Supplier terms (summary)

  • Registration: Supplier relationships are governed by separate supply agreements. Registration does not guarantee purchase orders.
  • Orders and delivery: Approved suppliers must deliver as per purchase orders and agreed quality standards. Failure to meet delivery or quality expectations may result in termination of the supply relationship.
  • Payments: Supplier payment terms will be agreed in supplier contracts and invoices are payable per agreed terms.

15. Complaints, disputes and refunds

  • Refunds: Refunds are governed by our Refund Policy. Where eligible, approved refunds will normally be processed within 14 business days.
  • Dispute resolution: We aim to resolve disputes amicably. If unresolved, parties may pursue mediation or other dispute resolution mechanisms. These Terms do not remove your right to seek remedies in court where permitted by law.

16. Termination

  • By customer: You may terminate ongoing services per the notice terms in your service agreement. Any outstanding fees for services performed up to termination remain payable.
  • By Kisii Pest Control: We may suspend or terminate services for non-payment, breach of these Terms, unsafe conditions, misrepresentation, or illegal activity. We will aim to give reasonable notice where possible.

17. Changes to services and these Terms

  • Service changes: We may modify service procedures, product lines, pricing or staffing as needed to improve delivery, meet regulatory changes, or respond to market conditions. We will notify affected customers where possible.
  • Changes to Terms: We may update these Terms from time to time. The revised Terms will be published and the date of last update revised. Continued use after changes constitutes acceptance. For significant changes we will attempt to notify affected customers directly.

18. Severability and entire agreement

  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
  • Entire agreement: These Terms, together with any quotation, service agreement, supplier contract or purchase order, constitute the entire agreement between you and Kisii Pest Control relating to the subject matter.

19. Governing law

These Terms are governed by the laws of the Republic of Kenya. Parties submit to the non-exclusive jurisdiction of Kenyan courts, subject to dispute resolution clauses in specific agreements where applicable.
